    I cannot recommend an attorney, however you will be required by any attorney to receive credit counseling before you can file. The certificate is good for 180 days. You can go to our website www.cccsoftheozarks.org and apply for the counseling through us, you will then be ready to file when the time is right. You can file anytime within 180 days of the counseling certificate date.

    Hi,

    I lost my job in Sept. '08 and got way behind on my mortgage, car payment, credit cards payments and student loan. I have worked out a couple of credit card "hardships" a mortgage "hardship" and a student loan "hardship". I still can't pay what they are wanting because of the really high rate of my monthly mortgage payment. I also have no insurance and will probably not be eligible for medicaid even though I am applying for Social Security Disability due to anxiety disorder, degenerative arthritis in the neck and lower spine and bone spurs and disc disease. I found a large lump on my left breast about 15 days ago with a lot of redness and pain, so I went to the ER. They made an appointment for me to see a surgeon and a mammogram. The mammogram is tomorrow and the surgeon was last week and again on next Monday after the mammogram. I know I will not be able to pay these bills if Medicaid doesn't and I simply can't afford any more payments at this time. I have a shut off notice for my utility bill and can't even pay that right now. I am thinking about filing bankruptcy but am really scared of that. Any suggestions? Please help.

    I would be careful about filing for bankruptcy too quickly. It appears that you will be having additional medical bills with your current condition. If you file now, then these medical bills that will be coming in the future cannot be claimed under your bankruptcy. Card companies will have to notify you if they are taking you to court and have you served. You will have plenty of time to prepare an answer to them before the court date. If they do take you to court, appear at the time and place and plead your case to the judge. Judges will listen to both sides. Also if and when you get to court, ask the other attorney to produce the original paperwork that bears your signature. A lot of time they do not have this paperwork.
